Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Captiofy platform and services ("Service") provided by Captiofy ("Captiofy", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

Captiofy provides a real-time live captioning and multilingual translation service for live streams. The Service processes audio from your RTMP stream, generates captions using AI speech recognition, translates them via the DeepL API, and delivers them to viewers through an embeddable player.

The Service is intended for business and professional use. By using it you confirm that you are acting in a professional or commercial capacity, not as a consumer.

2. Account registration and eligibility

  • You must be at least 18 years old to use the Service.
  • You must provide accurate information during the demo request and onboarding process.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.

3. Acceptable use

You agree to use the Service only for lawful purposes. You must not:

  • Stream or process content that is illegal, harmful, defamatory, obscene, or infringes third-party rights.
  • Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Service.
  • Use the Service to train, fine-tune, or build competing AI or machine learning models.
  • Circumvent usage limits, access controls, or billing mechanisms.
  • Resell or sub-license the Service without express written permission.
  • Use the Service in a way that imposes an unreasonable or disproportionate load on our infrastructure.

We reserve the right to suspend or terminate accounts that breach these restrictions without prior notice.

4. Plans, billing and payment

Captiofy offers subscription plans billed monthly in advance. Usage is measured by streaming hours — the total time your RTMP stream is connected to Captiofy, regardless of the number of concurrent viewers.

  • Overage: if you exceed your plan's monthly streaming hours, additional usage is billed per minute at the rate published in your plan details.
  • Billing cycle: subscriptions renew automatically on the same calendar date each month unless cancelled.
  • Payment: processed by Stripe. You authorise us to charge the payment method on file at the start of each billing cycle.
  • Taxes: prices are shown exclusive of VAT. Applicable Spanish and EU VAT will be added at checkout where required by law.
  • Failed payments: if a payment fails, we will retry and notify you by email. Failure to pay within 7 days may result in service suspension.

5. Cancellation and refunds

You may cancel your subscription at any time from your account dashboard or by contacting [email protected]. Cancellation takes effect at the end of your current billing period; you retain access until then.

We do not provide pro-rata refunds for unused time within a billing period. Exceptions may be considered in cases of significant service failure attributable to Captiofy, assessed on a case-by-case basis.

6. Service availability and SLA

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be announced with reasonable notice. Unplanned outages will be communicated via our status page.

Formal Service Level Agreements (SLAs) with uptime guarantees and credit terms are available exclusively on the Elite plan and above, as specified in your subscription agreement.

7. Intellectual property

All intellectual property rights in the Captiofy platform, including its software, design, and branding, remain the exclusive property of Captiofy. These Terms do not transfer any ownership to you.

You retain all rights to your own content (audio streams, transcripts, and recordings). By using the Service, you grant Captiofy a limited, non-exclusive licence to process your content solely for the purpose of delivering the Service to you.

8. Confidentiality

Both parties may have access to confidential information belonging to the other. Each party agrees to keep such information confidential and not to disclose it to third parties without prior written consent, except as required by law.

9. Limitation of liability

To the maximum extent permitted by applicable law, Captiofy's total aggregate liability arising out of or in connection with these Terms shall not exceed the total fees paid by you in the 3 months preceding the claim.

We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or loss of business opportunity, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

10. Warranties and disclaimer

The Service is provided "as is" and "as available". We do not warrant that caption accuracy will be error-free — AI transcription and translation are inherently probabilistic and results may vary depending on audio quality, speaker accent, domain vocabulary, and network conditions.

We make reasonable efforts to calibrate the system to your specific content before your first session, but we cannot guarantee specific accuracy thresholds.

11. Termination

Either party may terminate these Terms at any time. We may terminate your account immediately if you materially breach these Terms, or if we are legally required to do so. Upon termination, your access to the Service will cease and your data will be handled in accordance with our Privacy Policy.

12. Governing law and disputes

These Terms are governed by the laws of Spain. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Girona, Spain, unless mandatory consumer protection laws in your country of residence require otherwise.

13. Changes to these Terms

We may update these Terms from time to time. We will notify active customers by email at least 30 days before any material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
